By accessing or using the Defensia platform at defensia.cloud (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Defensia, a software product and brand with professional activity in Barcelona, Spain ("Operator," "we," "us," or "our").
We reserve the right to update or modify these Terms at any time. Your continued use of the Service after any such changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
Defensia is a server security platform designed to protect Linux servers from a wide range of cyber threats. The Service provides the following capabilities:
The Service operates through an agent software component that is installed on the customer's Linux servers. The agent communicates with Defensia's cloud infrastructure to receive threat intelligence updates, report security events, and synchronize protection rules across your server fleet.
To use the Service, you must create an account by providing accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials, including your password, and for all activities that occur under your account.
You agree to immediately notify us at support@defensia.cloud of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to protect your account credentials.
You must be at least 18 years of age to create an account and use the Service. By creating an account, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.
Defensia offers a free plan and paid subscription plans (the "Pro" plan). The features and limitations of each plan are described on our pricing page at defensia.cloud. Paid subscriptions are available on both monthly and annual billing cycles.
All payment processing, invoicing, sales tax, VAT, and other applicable tax compliance for paid subscriptions is handled by our authorized payment provider, which acts as our merchant of record. When you purchase a paid subscription, your transaction is processed by our payment provider, and you agree to their terms and conditions in addition to these Terms. Our payment provider is responsible for issuing invoices and handling payment-related inquiries.
Subscription fees are billed in advance on a recurring basis according to your chosen billing cycle. Unless you cancel your subscription before the end of the current billing period, your subscription will automatically renew and you authorize our payment provider to charge the applicable subscription fee for the next billing cycle.
Defensia offers a free plan that allows you to protect one (1) server at no cost. The free plan has no time limit and does not require a credit card to activate. The free plan includes core security features as described on our pricing page.
We reserve the right to modify the features and limitations of the free plan at any time. If you wish to protect additional servers or access advanced features, you may upgrade to a paid subscription at any time.
You may cancel your paid subscription at any time from your account dashboard. Upon cancellation, your subscription will remain active until the end of the current billing period. After the billing period ends, your account will be downgraded to the free plan and you will no longer be charged.
Cancellation does not entitle you to a prorated refund for the remaining portion of your current billing period, except as described in Section 7 (Refunds).
We offer a full refund within thirty (30) days of your initial purchase if you are not satisfied with the Service. To request a refund, please contact us at support@defensia.cloud within the 30-day period. Refunds are processed by our payment provider and will be returned using the original payment method.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You specifically agree not to:
Violation of these acceptable use terms may result in immediate suspension or termination of your account without prior notice or refund.
By using the Service, you acknowledge and accept the following:
(a) Firewall Modifications. The Service modifies firewall rules (iptables/nftables) on your servers. These rules control which IP addresses can access your server. Improperly configured rules may result in blocked access to your own server.
(b) IP Whitelisting Responsibility. The Service provides an IP Whitelisting feature that prevents the automated threat detection system from blocking whitelisted IP addresses. IT IS YOUR RESPONSIBILITY to add your own IP addresses (and those of any authorized administrators) to the whitelist before relying on automated protection features. Failure to whitelist your IP may result in the automated system blocking your access if your IP is mistakenly identified as a threat.
(c) Manual Actions. Manual actions you take through the Service — including creating firewall rules, banning IP addresses, and enabling country-level geoblocking — are applied immediately and may override whitelist protections. You are solely responsible for the consequences of manual firewall configurations.
(d) Alternative Access Methods. YOU ARE SOLELY RESPONSIBLE for maintaining alternative access methods to your servers (such as out-of-band console access, IPMI/KVM, hosting provider recovery console, or physical access) independent of the Service. We strongly recommend that you always have at least one access method that does not depend on network connectivity through the server's firewall.
(e) No Liability for Access Loss. We are not responsible for any loss of access to your servers resulting from firewall rules applied by the Defensia agent, whether configured manually by you or applied automatically by the threat detection system.
(f) Backups and Disaster Recovery. You are solely responsible for ensuring that you have adequate backups and disaster recovery procedures for your servers independent of the Service.
(g) False Positives. The automated threat detection and banning features may occasionally produce false positives, blocking legitimate IP addresses. You accept this risk as inherent to any automated security system and acknowledge that the IP Whitelisting feature is the provided mechanism to mitigate this risk.
The Defensia platform, including but not limited to its software, agent code, website, documentation, logos, trademarks, and all related intellectual property, is and shall remain the exclusive property of Defensia. These Terms do not grant you any ownership rights in the Service or its components.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service and install the agent software on your servers solely for the purpose of protecting your own infrastructure in accordance with these Terms and your subscription plan.
Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in our Privacy Policy.
The Defensia agent collects security-related data from your servers, including IP addresses of attackers, failed login attempts, and system security metrics. This data is used to provide the Service and to enhance collective threat intelligence for all users of the Defensia network. We do not collect or access your server's application data, user files, or any data unrelated to security operations.
We strive to maintain the highest possible availability of the Defensia platform and will use commercially reasonable efforts to ensure the Service is accessible and operational. However, we do not guarantee uninterrupted or error-free operation of the Service.
The Service may be temporarily unavailable due to scheduled maintenance, software updates, or circumstances beyond our control, including but not limited to network outages, infrastructure failures, or force majeure events. No guaranteed Service Level Agreement (SLA) is provided for accounts on the free plan.
Note that the Defensia agent operates locally on your server and will continue to enforce existing protection rules even if the cloud platform is temporarily unreachable. New threat intelligence updates will be applied once connectivity is restored.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY SECURITY THREAT WILL BE DETECTED OR PREVENTED.
YOU EXPRESSLY ACKNOWLEDGE THAT THE SERVICE MODIFIES FIREWALL CONFIGURATIONS ON YOUR SERVERS AND THAT SUCH MODIFICATIONS CARRY INHERENT RISKS, INCLUDING THE POSSIBILITY OF BLOCKING LEGITIMATE TRAFFIC OR LOSING ACCESS TO YOUR OWN SERVERS. THE SERVICE IS PROVIDED AS A TOOL TO ASSIST WITH SERVER SECURITY, AND WE MAKE NO GUARANTEES REGARDING ITS EFFECTIVENESS OR SUITABILITY FOR YOUR SPECIFIC USE CASE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE OPERATOR, ITS COLLABORATORS, PARTNERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED EUROS (EUR 100), WHICHEVER IS GREATER.
The Service is designed to enhance the security of your servers but cannot guarantee absolute protection against all threats. You acknowledge that no security solution can provide complete immunity from attacks, and you remain ultimately responsible for the security of your systems.
You agree to indemnify, defend, and hold harmless the Operator and its affiliates, collaborators, and partners from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:
We reserve the right to modify or replace these Terms at any time at our sole discretion. When we make material changes, we will notify registered users via email at the address associated with their account and update the "Last updated" date at the top of this page.
Material changes will take effect no earlier than thirty (30) days after notification. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must discontinue use of the Service and cancel your account.
These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Spain.
If you are a consumer residing in the European Union, you may also be entitled to invoke the mandatory consumer protection laws of your country of residence. Nothing in these Terms affects your rights as a consumer under applicable EU consumer protection legislation.
